Educational objectives

The course will examine the discipline of bankruptcy proceedings, reformed in five stages: Decree Law March 14, 2005, n. 35 converted into Law May 14, 2005, n. 80; d. lgs. January 9, 2006, n. 5; d. lgs. September 12, 2007, n. 169 (so-called corrective decree); Law June 18, 2009, n. 69; Decree Law May 31, 2010, n. 78 converted into Law July 30, 2010, n. 122 and, most recently, Decree Law June 22, 2012, n. 83 converted into Law August 7, 2012, n. 134; Decree Law October 18, 2012, n. 179 converted into Law 17 December 17, 2012, n. 221; Decree Law June 21, 2013, n. 69, converted into Law August 9, 2013, n. 98.

4. The bodies responsible for the performance of the procedure: court, judge delegate, trustee and the creditors' committee
5. Effects of bankruptcy for the bankrupted
6. Effects of bankruptcy for creditors
7. Effects of bankruptcy on legal acts detrimental to creditors
8. Effects of bankruptcy on legal relationships.
9. The procedure for defining liabilities
10. The administration and liquidation of the bankruptcy assets
11. The distribution of bankruptcy assets
12. The bankruptcy of companies.
13. The closure of the failure
14. The ‘’esdebitazione’’
PART II - THE NEGOTIATED REGULATION OF THE CRISIS
1. The court settlement
2. The composition before bankruptcy
3. The debt restructuring agreements
PART III: THE INSOLVENCY ADMINISTRATIVE PROCEDURES
1. Compulsory administrative winding up
2. The administration of large firms

Prerequisites
Proven knowledge of the Civil Law and Business Law.

Teaching materials
It is essential an updated edition of the Bankruptcy Law (Royal Decree No. 267 of 1942 as amended).
It is also recommended relevant to Part I:

Examination
The exam is oral, but it is given to students the opportunity of a written intermediate examination and of a written examination at the end of the course.
