Educational objectives:
The course will examine the discipline of bankruptcy proceedings.

Content of the course:
It is a course divided into two parts.
Parte 1: The Bankruptcy (Prof. Marina Spiotta), 4 CFU 32 hours

PART I - THE BANKRUPTCY
1. The conditions of failure
2. The procedure for insolvency declaration
3. The adjudication in bankruptcy and appeals
4. The bodies responsible for the performance of the procedure: court, judge delegate, trustee and the creditors' committee
5. Effects of bankruptcy for the bankrupted
6. Effects of bankruptcy for creditors
7. Effects of bankruptcy on legal acts detrimental to creditors
8. Effects of bankruptcy on legal relationships.
9. The procedure for defining liabilities
10. The administration and liquidation of the bankruptcy assets
11. The distribution of bankruptcy assets
12. The bankruptcy of companies.
13. The closure of the failure
14. The ‘’esdebitazione’’

Part 2: The negotiated composition of the crisis and the insolvency administrative procedures (Prof. Maria Di Sarli), 4 CFU, 32 hours

Prerequisites
Proven knowledge of the Civil Law and Business Law.


Teaching materials:
It is essential an updated edition of the Bankruptcy Law (Royal Decree No. 267 of 1942 as amended).
It is also recommended relevant to Part I:

Frequency mode

The class attendance is required to take the tests.

Examination:
The exam is oral, but it is given to attending students the opportunity of a written examination at the end of the course.
